GOV.UK: legal advice at the police stationYour right to legal advice
You have the right to free, independent legal advice when questioned at a police station. The duty solicitor service is available 24 hours a day. Police station advice is separate from the eligibility tests that apply to legal aid for court representation.
What a solicitor can help with
- Understanding the allegation and information disclosed by the police
- Getting advice in private before the interview
- Considering how to approach questions in your circumstances
- Understanding the next steps and any release conditions
From the interview to the next stage
An interview does not establish guilt. What follows depends on the investigation and any decision made by the police or prosecution. Your solicitor can explain what you have been told, any required attendance and the work that may follow.
Enquiring for someone else
If a family member has been arrested, practical information such as the police station and the person’s name can help a solicitor establish what is happening. Confidential case details can only be discussed where the solicitor is authorised to do so.
Can I ask for advice after initially declining it?
Does asking for a solicitor mean I look guilty?
What if the police have invited me to a voluntary interview?
